Lawsuit Filed in New Jersey Court Alleging DePuy’s Negligence
At least one claim has been filed in the United States District Court for the State of New Jersey alleging that DePuy Orthopaedics’ Pinnacle hip replacement system is “unsafe and has not been tested.” Anna Maria Sillman, a resident of Pennsylvania, filed a lawsuit alleging the submission was negligent since the products on which approval was based had not undergone premarket testing.
Most of the complaints regarding the product have alleged that it has loosened, causing severe pain to the patient any time any weight is put on the joint. Additionally, the New York Times reported that researchers have found that metal-on-metal devices like the Pinnacle may put the recipient patient at risk of developing metal poisoning due to metal particles flaking off and embedding in the surrounding tissue.
Product liability lawsuits like the one Ms. Sillman is bringing against DePuy give consumers a means to protect themselves from negligent companies that put the bottom line first. When someone is hurt by a product and the court finds the product’s manufacturer liable for the harm, it must compensate the victim for the damages actually incurred, such as medical bills and lost wages. The victim may also be compensated for the time spent in pain from the harm, if the court should so decide.
