Five Things to Know Before Suing DePuy/Johnson & Johnson
If you’re considering legal action against DePuy Orthopaedics (and its parent company Johnson & Johnson), there are some things you need to consider before you do anything else. - The date of your implant surgery. If you received a hip implant before 2003 and not since then, you are not affected by the DePuy recall.
- The brand and model of your implant. DePuy has recalled its ASR XL Acetabular System and its ASR Hip Resurfacing System.
- The name of the surgeon who performed the surgery. The surgeon who performed your surgery will likely be called upon to testify.
- Whether your current doctor thinks you need revision surgery. Only by receiving a complete medical diagnosis can you learn whether or not you are in any immediate danger.
- That joining a “class action” is unlikely to get you compensation. It is doubtful that a class action against DePuy will get victims anything substantial when compared to the actual losses suffered due to having received a faulty implant, not to mention significant pain and suffering.
