Do I have a case if my replacement hip was recalled?
If you received a replacement hip (a ball and/or socket) of the “ASR” brand manufactured by DePuy Orthopaedics (a Johnson & Johnson company) and recently recalled, you might have a case against the manufacturer. (If you do not know whether your replacement hip component[s] have been recalled, ask your doctor.)
Johnson & Johnson has recalled its ASR Hip Resurfacing System and its ASR XL Acetabular System because the units are defective. Recipients of either or both of the units are being contacted about the recall and “revision” surgery to replace the faulty devices.
Although J&J has announced that it intends to assist recipients of the recalled devices and pay for the costs of doctor visits, tests, and procedures associated with the recall, you might have suffered harm that the manufacturer is not volunteering to compensate you for. Yes I have been to a specialist about my hip replacement. I have had a few problems in the past 2 years and I had my DePuy replacement 4 1/2 years ago. I have had blood tests and I have high sign of metal fragments in my blood stream. I also do have pain now and then as it aches, can’t sleep on this side, and have used a walking stick now and then. My doctor told me to come back in 10 weeks to have more blood tests and go from there. Does this sound right, or is he just delaying the process?
