Do I have a case if my replacement hip was recalled?

If you received a replacement hip (a ball and/or socket) of the “ASR” brand manufactured by DePuy Orthopaedics (a Johnson & Johnson company) and recently recalled, you might have a case against the manufacturer. (If you do not know whether your replacement hip component[s] have been recalled, ask your doctor.)

Johnson & Johnson has recalled its ASR Hip Resurfacing System and its ASR XL Acetabular System because the units are defective. Recipients of either or both of the units are being contacted about the recall and “revision” surgery to replace the faulty devices.

Although J&J has announced that it intends to assist recipients of the recalled devices and pay for the costs of doctor visits, tests, and procedures associated with the recall, you might have suffered harm that the manufacturer is not volunteering to compensate you for. To recover damages, you might need to sue. The amount of your potential monetary recovery will relate to the severity of your harm.
